Charges Dismissed in 2009 Death

Murder charges against Shelby Moore and Brandon Harber, who were arrested in April 2010 in the November 2009 death of Trey Noah, have been dismissed by Gillespie County District Attorney Bruce Curry.

The dismissal occurred Monday, March 3, after an appeals court ruled that a statement made during an interrogation during the investigation had to be suppressed because it was improperly taken. The statement was ordered to be suppressed, first by the Honorable Keith Williams, and the ruling was upheld by the Fourth Court of Appeals.

Following the dismissal, Curry took the case back to the grand jury, presenting all of the evidence except for the suppressed statement. The grand jury indicted Brandon Harber on evidence-tampering charges, but no billed all others.

According to Curry, Moore is now free of charges, there is no active investigation, and no other actions are pending in the court, other than Harber's indictment.
