On August 7 Pedernales Electric ended its legal relationship with Moursund, Moursund & Moursund. In a letter to the firm terminating the relationship, PEC General Manager Juan Garza acknowledged the firm’s long-term service to PEC, but stated that it was “time to move in another direction.” The founder of the legal firm, A.W. Moursund, served as PEC’s General Counsel from January 1, 1952, until October 23, 2000. After that date, the firm took on the role of general counsel and had been retained in the position of legal counsel, participating in monthly Board meetings, performing real estate title work, reviewing easement documents and handling collection activities. Since taking the helm as General Manager, Garza has committed to review all of PEC’s business relationships and activities.
In other legal news, Clark, Thomas & Winters, a firm representing PEC in a civil lawsuit, has agreed that it “will not assert the affirmative defense of release” in the settlement agreement of the lawsuit, essentially agreeing not to raise their defense of release as stated in the settlement agreement. “Clark, Thomas & Winters has taken this positive step independently,” Garza said. “The settlement is currently in the appeals process, but this action should help curtail the notion of a conflict of interest and help us continue on a path toward resolution.”
